These booking terms and conditions for residents of the United Kingdom (“Booking Conditions”) set out the terms on which Fora Travel, Inc (“Fora”, “we”, “us” or “our”) agree to sell travel services and package holidays to you.

We do not own or provide any of the services, facilities or travel services which we sell to you. These are provided by third parties whom we source to provide the travel services and facilities.

Please note, the terms, “Package”, “travel services” and “Organiser” that we use in these Booking Conditions are as defined in the Package Travel and Linked Travel Arrangements Regulations 2018 (“PTRs”).

The Booking Conditions which apply to your booking vary depending on the type of booking you have made with us:

  1. Third-Party Travel Services

    We act solely as agent in relation to package holidays organised by third-party tour operators and single-component travel services, such as accommodation-only bookings (collectively known as “Third-Party Travel Services” in these Booking Conditions). Your contract for the provision of Third-Party Travel Services is with the third-party supplier disclosed to you at the time of booking and named on the booking confirmation (the “Supplier/Principal”). Section A and B of these Booking Conditions apply to bookings of Third-Party Travel Services.

  2. Fora Packages

    For certain bookings, we combine and sell multiple travel services as a Package (“Fora Packages”). A Fora Package is formed when at least two (or more) travel services (e.g. hotel accommodation and flights or a cruise, a flight and car hire) are combined by us and sold to you under the same booking. We will sell the individual travel services as agent for the relevant Supplier/Principals named on your booking confirmation. However, for the purpose of the PTRs, we will be the Organiser of the Fora Package and will therefore have certain obligations to you regarding the performance of the travel services included in the Fora Package. Sections A and C of these Booking Conditions apply to Fora Packages.

Fora partners with independent travel advisors (“Travel Advisors”) who use Fora’s platform to arrange and book travel services on your behalf. These Travel Advisors act on Fora’s behalf in facilitating your booking but your contractual relationship for the travel services is as described in these Booking Conditions, and the Travel Advisors do not themselves become a party to your contract for the travel services. Travel Advisors may have their own separate contract with you.

Section A: applicable to all bookings

1. Your relationship with Fora Travel, Inc.

1.1.
Your booking is with Fora Travel, Inc. registered in Delaware under company number 5989959 with its registered office at 228 Park Avenue South, Suite 53272, New York, 10003 – 1502, USA. However, you will make and manage your booking through your Travel Advisor.
1.2.
All correspondence relating to your booking should be directed to your Travel Advisor. Where needed, your Travel Advisor can liaise with us directly, on your behalf. Should you need to contact us directly for any reason, you can do so by writing to us by email at support@fora.travel. You can also contact us via telephone on +44 333 004 7646. Please note that our registered office address is not a correspondence address.
1.3.
Please read these Booking Conditions carefully before booking with us. If there is anything within these Booking Conditions that you do not understand, then please contact us at the details given in clause 1.2 above to discuss what this means for you. If you do not agree to these Booking Conditions you must not make a booking with us.
1.4.
The lead name on the booking will be the person responsible for the booking (the “Lead Name”). The Lead Name shall be responsible for making all payments, for making any amendment and cancellation requests, for paying any additional charges in relation to the booking and for all other matters concerning the booking. The Lead Name must be at least 18 years old at the time of booking. References in these Booking Conditions to “you” and “your” mean the Lead Name and all persons named on the booking (including anyone who is added or substituted at a later date) or any of them.
1.5.
The Lead Name must ensure and hereby confirms that the details provided for all parties named on the booking are full and accurate, that all parties agree to be bound by these Booking Conditions and that the Lead Name has the authority to accept and does accept these Booking Conditions on behalf of all persons named on the booking. The Lead Name agrees to check all descriptions on the travel documentation received after booking and to inform us immediately of any errors or instances where personal details do not correspond with those shown on the passports of those travelling under the booking.

2. Your booking

2.1.
For all bookings, a contract will be formed when payment has been received, and a booking confirmation has been issued.
2.2.
Your Travel Advisor will provide a copy of the booking confirmation and itinerary to the Lead Name on the booking.
2.3.
It is your responsibility to check the booking confirmation, Air Travel Organiser’s Licence (“ATOL”) Certificate (where applicable), and any other documents we, or your Travel Advisor send you carefully and to let your Travel Advisor know immediately in the event of any error or inaccuracy, as it may not be possible to make changes later. Please ensure that the names on the booking confirmation exactly match the names as spelt in your passport (including all middle names).
2.4.
We shall be under no obligation to issue a booking confirmation after you have placed a booking with us. We will not issue such a confirmation if we discover an error in the pricing of the booking (see clause 5.2 below) or if the travel services (or any part of them) are no longer available.
2.5.
If, for any reason, we are unable to accept your booking, we, or your Travel Advisor, will inform you of this and not process your booking further. We, or your Travel Advisor, will then arrange for you to be refunded any part of booking already paid, unless you decide to use that payment towards a different booking.
2.6.
We will assign a reference number to your booking and tell you what it is when we confirm your booking. It will help us if you can tell us, or your Travel Advisor, the booking reference number whenever you contact us about your booking.

3. Supplier/Principal(s) terms and conditions

3.1.
The Supplier/Principals have their own booking conditions and conditions of carriage (“Supplier/Principal Terms and Conditions”), and these will govern your contract with the Supplier/Principal.
3.2.
Supplier/Principal Terms and Conditions will be incorporated into your booking with us, and in the event of any conflict between the Supplier/Principal Terms and Conditions and our Booking Conditions, the Supplier/Principal Terms and Conditions will prevail, save to the extent that any term in the Supplier/Principal Terms and Conditions is deemed to be invalid or unenforceable, in which event our Booking Conditions will prevail.
3.3.
Some of the Supplier/Principal Terms and Conditions may limit or exclude liability to you on the part of the relevant Supplier/Principal and, by virtue of their application to your booking with us, may also limit or exclude our liability to you, and are often subject to International Conventions. Where relevant, copies of such conventions can be provided to you upon request. The Supplier/Principal Terms and Conditions applicable to your booking will be displayed to you on the final itinerary page and can also be accessed through a link on the booking confirmation email.

4. Payment

4.1.
When you make your booking, you will be advised of the applicable payment terms at the time of booking. You will be required to pay either a deposit or, where applicable, the full amount at the time of booking, as notified to you by your Travel Advisor during the booking process.
4.2.
Where a deposit is payable, the amount of the deposit will be confirmed to you at the time of booking. Certain arrangements may require a higher deposit or full payment at the time of booking – if that’s the case, your Travel Advisor will inform you of this at the time of booking. If you pay a deposit, you will need to pay the balance by the due date notified to you.

5. Prices

5.1.
We may change the advertised price of any travel services from time to time. We try hard to make sure that the advertised price is the most up-to-date price, but prices can change at short notice. Your Travel Advisor will confirm the actual price at the time of booking, as advised to us by the relevant Supplier/Principal or, where applicable, for Fora Packages, by us as Organiser.
5.2.
We advertise a large number of travel services and sometimes errors do occur. If there is a mistake, and the actual price is lower than that given at the time of booking, you will only be charged the lower amount. If the price is higher, your Travel Advisor will contact you for instructions or we may reject the booking (at our sole discretion). Your Travel Advisor will notify you so you can decide how you would like to proceed.
5.3.
If we accept and process your booking where a pricing error is obvious and unmistakable and could reasonably have been recognised by you as a mispricing, we may cancel your booking and refund you any sums you have paid.
5.4.
The price of your booking includes all mandatory taxes, fees and charges known to us at the time of booking. Certain charges (such as local taxes or resort fees) may be payable locally directly to the relevant supplier. Where this is the case, your Travel Advisor will notify you of the amount to be paid locally. If the local charges are not capable of being calculated in advance, your Travel Advisor will provide you with sufficient information to allow you to understand the likely cost.
5.5.
Your Travel Advisor will notify you of any charges which are payable locally. These will not be collected by Fora at the time of booking. It is your responsibility to ensure these are paid locally when requested.

6. Your responsibilities

6.1.
Travel insurance. You must purchase adequate travel insurance for your trip. It is your responsibility to ensure that the insurance cover you purchase is suitable and adequate for your particular needs, ensuring it covers all the activities you plan to undertake and protects you against cancellation, medical and repatriation expenses and personal liability claims. If you wish to arrange additional activities while you are away, please check your cover before doing so. Please read your policy details carefully and take them with you on holiday. If you choose to travel without adequate insurance cover, we will not be liable for any losses suffered by you in respect of which insurance cover would otherwise have been available.
6.2.
Travel advice. For up-to-date travel advice from the UK government, visit www.gov.uk/foreign-travel-advice and travelaware.campaign.gov.uk. We recommend that you consult these websites before booking in order to make an informed decision about your chosen destination, and again before departure.
6.3.
Passports & Visas. It is your responsibility to check and fulfil the passport, visa, health and immigration requirements applicable to your trip. We can only provide general information about this. You must check requirements for your own specific circumstances with the relevant Embassies and/or Consulates and your own doctor as applicable. Requirements do change, and you must check the up-to-date position in good time before departure. Most countries now require passports to be valid for at least 6 months after your return date. If your passport is in its final year, you should check with the Embassy of the country you are visiting. We do not accept any responsibility if you cannot travel or incur any other loss because you have not complied with any passport, visa, immigration requirements or health formalities. You agree to reimburse us in relation to any fines or other losses which we incur as a result of your failure to comply with any passport, visa, immigration requirements or health formalities.
6.4.
Special requests. It is your responsibility to notify your Travel Advisor of any special requests at the time of booking e.g. dietary conditions, room location, a particular facility at a hotel etc. You should then confirm your requests in writing. Your Travel Advisor will pass your requests to us, and we will in turn pass them on to the relevant Supplier/Principal but we cannot guarantee that they will be fulfilled. The fact that a special request has been noted on your confirmation invoice or any other documentation or that it has been passed on to the Supplier/Principal or services provider, is not confirmation that the request will be fulfilled.
6.5.
Fitness to Travel, Disabilities and Medical Conditions. If you or a member of your party has a disability or medical condition or is a person of reduced mobility, please let your Travel Advisor know before making a booking so we can ensure that the travel services are suitable for you. Acting reasonably, if the relevant Supplier/Principals are unable to properly accommodate the needs of the person(s) concerned, we will not confirm your booking or, if you did not give us full details at the time of booking, we may cancel it and impose applicable cancellation charges, when we become aware of these details.
6.6.
Behaviour. You are expected to conduct yourself in an orderly and acceptable manner and not to disrupt the enjoyment of others. If in our or any Supplier/Principal’s opinion or in the opinion of any other person in authority, your behaviour or that of any member of your party is causing or is likely to cause distress, danger or annoyance to any other customers or any third party, or damage to property, or to cause a delay or diversion to transportation, we reserve the right to terminate your booking immediately with no further liability to you. You and/or your party may also be required to pay for loss and/or damage caused by your actions and you and each member of your party will be jointly and individually liable for any damage or losses caused. Full payment for any such damage or losses must be paid directly to the Supplier/Principal prior to departure. If you fail to make payment, you will be responsible for meeting any claims (including legal costs) subsequently made against us because of your actions together with all costs we incur in pursuing any claim against you.

7. ABTA

7.1.
We are a Member of ABTA, membership numbers: Y6886 and P8899. We are obliged to maintain a high standard of service to you by ABTA’s Code of Conduct. We can also offer you ABTA’s scheme for the resolution of disputes which is approved by the Chartered Trading Standards Institute. If we cannot resolve your complaint, go to www.abta.com to use ABTA’s simple procedure. Further information on the Code and ABTA’s assistance in resolving disputes can be found on www.abta.com.

8. How we may use your personal information

8.1.
We will only use your personal information as set out in our Privacy Policy for UK/EEA Travellers.
8.2.
In the event of our insolvency we, or any appointed insolvency practitioner, may disclose your personal information to the CAA and/or ABTA so that they can assess the status of your booking and advise you on the appropriate course of action under any scheme of financial protection. 9. Accommodation ratings and standards

9.1.
All ratings are as provided by the relevant Supplier/Principal. These are intended to give a guide to the services and facilities you should expect from your travel services. Standards and ratings may vary between countries, as well as between suppliers. We cannot guarantee the accuracy of any ratings given.

10. Descriptions

10.1.
All descriptions and content on our website or otherwise issued by us are intended to present a general idea of the travel services. Not all details of the relevant services can be included on our website. All services shown are subject to availability. If you require any further details in respect of any travel services or any other services please contact your Travel Advisor who will liaise with us or the relevant Supplier/Principal to obtain the information for you.

11. Complaints

11.1.
If you have a complaint about any part of your travel services, you must notify the relevant Supplier/Principal as soon as possible so they have the opportunity to resolve the issue locally. You must also inform your Travel Advisor straight away.
11.2.
If the matter is not resolved locally and you wish to follow this up, your Travel Advisor will contact us on your behalf, or you may contact us directly using the details in clause 1.2, within 28 days of your return to the UK giving your booking reference number and details of your complaint. If you fail to follow the requirement to report your complaint while on holiday, we or the Supplier/Principal will have been deprived of the opportunity to investigate your complaint and rectify it and this may affect your rights under this booking. Please also see clause 7 above on ABTA.
11.3.
Please note that where your booking is for a Third-Party Travel Service, we will forward your complaint to the Supplier/Principal. Since we act as an agent on behalf of the Supplier/Principal we are not responsible for any refunds or compensation payments and nor can these be made without the Supplier/Principal’s authorisation.

12. Other important terms

12.1.
These Booking Conditions and the associated booking confirmation set out the entire agreement between us. You are not relying upon any other statement, promise or assurance in relation to your booking.
12.2.
These Booking Conditions are between you and us. No other person shall have any rights to enforce any of their terms and conditions.
12.3.
If we do not insist immediately that you do anything you are required to do under these Booking Conditions, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you immediately, we can still require you to make the payment at a later date.
12.4.
We may transfer our rights and obligations with you under these Booking Conditions to another organisation, and we will do our best to notify you if this happens, but this will not affect your rights or our obligations under the Booking Conditions.
12.5.
If a court invalidates some of this contract, the rest of it will still apply. That means that if a court or other authority decides that some of these terms are unlawful, the rest will continue to apply.

13. Law and jurisdiction

13.1.
These Booking Conditions and any dispute or claim (including non-contractual disputes or claims) arising out of them, their subject matter or formation shall be governed by and construed in accordance with the law of England and Wales.
13.2.
You and we both agree that the courts of England and Wales will have exclusive jurisdiction to resolve any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these Booking Conditions or their subject matter or formation. However, if you live in Scotland, you can bring legal proceedings in respect of your booking in either the Scottish or the English courts. If you live in Northern Ireland, you can bring legal proceedings in respect of your booking in either the Northern Irish or the English courts.
13.3.
If you have any queries about these Booking Conditions, please contact us, or your Travel Advisor, before placing a booking via the contact details shown at clause 1.2.

Section B: third-party travel services

Where you have booked a Third-Party Travel Service with us, we act as an agent on behalf of the Supplier/Principal, and the additional terms in this Section B apply to your booking (in addition to Section A), as well as the Supplier/Principal’s Terms and Conditions.

14. Your contract

14.1.
When making your booking, we will arrange for you to enter into a contract with the applicable Supplier/Principal of the Third-Party Travel Services, as specified on the confirmation invoice provided to you by your Travel Advisor. Your booking with us is subject to:
  1. these Booking Conditions; and
  2. the Supplier/Principal’s Terms and Conditions.
14.2.
We advise you to read both carefully prior to booking. The Supplier/Principal’s Terms and Conditions may limit and/or exclude the Supplier/Principal's liability to you.
14.3.
Your booking is confirmed when the Supplier/Principal issues the booking confirmation. At that point, a contract will come into force between you and the relevant Supplier/Principal for the travel services set out in the booking confirmation. If your confirmed booking includes a flight, the Supplier/Principal will also issue an ATOL Certificate. The Supplier/Principal will send all booking documentation (including, where applicable, an ATOL Certificate) to your Travel Advisor to forward on to you. You must check all documentation provided to you and notify your Travel Advisor immediately of any errors.

15. Payment

15.1.
Any money paid to us in respect of a Third-Party Travel Services booking covered by an ATOL is held by us on behalf of and for the benefit of the Trustees of the Air Travel Trust at all times, but subject to our obligation to pay it to the ATOL holder for so long as the ATOL holder does not fail financially. If the ATOL holder does fail financially, any money held at that time by us or subsequently accepted from the consumer by us, is and continues to be held by us on behalf of and for the benefit of the Trustees of the Air Travel Trust without any obligation to pay that money to the ATOL holder.

16. Making a change to your booking

16.1.
If, after the Supplier/Principal has issued the booking confirmation, you wish to make an amendment to your booking, you must contact your Travel Advisor. Your Travel Advisor will then contact the relevant Supplier/Principal and let you know if the change is possible. Amendments can only be made in accordance with the Supplier/Principal’s Terms and Conditions. If the amendment is possible, your Travel Advisor will notify you of any changes to the price of the booking or anything else which would be necessary as a result of your requested amendment. Your Travel Advisor will provide this information to you and will request you to confirm whether you wish to go ahead with the amended booking. If the Supplier/Principal cannot make the amendment or the consequences of making the amendment (such as an increased price) are unacceptable to you, you may wish to cancel your booking in accordance with clause 17.
16.2.
Where your requested change can be met, before the change can be made, you must pay all costs and charges incurred or imposed by the Supplier/Principal. Please note that your Travel Advisor may charge an administrative fee for dealing with this amendment.
16.2.1.
Please note that elements of certain Third-Party Travel Services (such as flights) cannot be changed or transferred after they have been confirmed and any change could incur a cancellation charge of up to 100% of the cost of that travel service and require you to re-book.

17. Cancelling your booking

17.1.
You may cancel your confirmed booking at any time prior to departure. If you wish to do so, you must notify your Travel Advisor in writing, and your Travel Advisor will pass your cancellation request to the Supplier/Principal. Your cancellation will only take effect when the Supplier/Principal receives the written notification from your Travel Advisor.
17.2.
Cancellations can only be accepted in accordance with the Supplier/Principal’s Terms and Conditions and the Supplier/Principal’s cancellation charges will apply.
17.3.
Please note that you do not have the right to a “cooling off” period of 14 days. This right under the Consumer Contracts Regulations 2013 does not apply to contracts for travel services.

18. Changes and cancellations by the Supplier/Principal

18.1.
If the Supplier/Principal needs to make a significant change to your confirmed booking, or cancel your booking, they will inform your Travel Advisor as soon as reasonably possible, and your Travel Advisor will notify you. Your Travel Advisor will liaise with you regarding any alternative arrangements or options offered by the Supplier/Principal. As we act only as agent, we will have no further liability to you in relation to any changes or cancellation made by the Supplier/Principal.

19. Financial protection

19.1.
Where your Third-Party Travel Services booking is a “package” which includes flights, ATOL protection is provided by the Supplier/Principal. We are authorised by the Supplier/Principal to sell its flight-inclusive packages by way of an ATOL agency agreement. Your ATOL Certificate (where applicable) will identify the ATOL holder responsible for your protection.
19.2.
Where your Third-Party Travel Services booking is a “package” which doesn’t include flights, insolvency protection for your payments is provided by the Supplier/Principal.
19.3.
With the exception of Linked Travel Arrangements (see clause 21), we rely entirely on the Supplier/Principal’s financial protection arrangements in relation to Third-Party Travel Services.

20. Our responsibility for your booking

20.1.
We act as a booking agent on behalf of the relevant Supplier/Principal. As agent, we accept no responsibility for the acts or omissions of the Supplier/Principal or for the Third-Party Travel Services provided by them.
20.2.
Our only obligation to you is to exercise reasonable skill and care in arranging for you to enter into contract(s) with the Supplier/Principal of the Third-Party Travel Services. Our responsibilities are limited to making the booking in accordance with the instructions provided to us by your Travel Advisor. We accept no responsibility for any information about the Third-Party Travel Services that we or your Travel Advisor passes on to you in good faith, based on information supplied to us by the Supplier/Principal. However, in the event that we are found liable to you on any basis whatsoever, our maximum liability to you is limited to twice the cost of your booking (or the appropriate proportion of this if not everyone on the booking is affected).
20.3.
We do not exclude or limit any liability for death or personal injury that arises as a result of our negligence or that of any of our employees whilst acting in the course of their employment. For the avoidance of doubt, our Travel Advisors are independent contractors and are not our employees.

21. Linked Travel Arrangements

21.1.
Occasionally, we may facilitate a “Linked Travel Arrangement” (“LTA”). An LTA may be created if you book two or more different travel services (such as a hotel, flight or car hire) for the same trip under separate contracts and we either (i) enable you to select and pay for each service separately during the same visit to our booking service, or (ii) direct you to book an additional travel service with another provider within 24 hours of your first booking.
21.2.
A Linked Travel Arrangement is not a package holiday, and will not benefit from the same rights and protections as a Fora Package. Fora is not responsible for the proper performance of the travel services forming your LTA, except as set out in section A and section B of these Booking Conditions. In case of problems please contact the relevant Supplier/Principal.
21.3.
We have insolvency protection in place to refund your payments to Fora for any travel services which form part of the LTA and are not performed because of Fora’s insolvency. In practice, this means that the insolvency protection is very limited as most payments will be made directly to the Supplier/Principal, or where payments are made to Fora, they are only held by Fora for a very short period of time before being paid on to the Supplier/Principal. Please note that this does not provide a refund in the event of the insolvency of the relevant Supplier/Principal.
21.4.
Please see clause 33 for further information on the entity providing insolvency protection for LTA bookings.

Section C: Fora Packages

Where you have booked a Fora Package, the additional terms in this Section C apply to your booking (in addition to Section A).

22. Your contract

22.1.
Your Fora Package booking is a “multi-contract” Package. This means we shall arrange for you to enter into separate contracts with the Supplier/Principal of each travel service making up the Fora Package. We act as agent for each Supplier/Principal. However, we will be the Organiser of the Fora Package and will therefore have certain obligations to you regarding the performance of the travel services included in the Fora Package, as outlined in this Section C.
22.2.
Acceptance of your booking will take place when your Travel Advisor sends you a booking confirmation email that will confirm the details of your booking. If your confirmed Fora Package includes a flight, we will also issue you with an ATOL Certificate.
22.3.
Since your booking is for a “package holiday”, you will benefit from additional rights under the Package Travel and Linked Travel Arrangements Regulations 2018. We have outlined the key legal rights applicable to Package holidays at the end of these Booking Conditions.

23. Pricing

23.1.
We reserve the right to increase the price of your confirmed Fora Package solely to allow for increases which are a direct consequence of changes in:
  1. the price of the carriage of passengers resulting from the cost of fuel or other power sources;
  2. the level of taxes or fees applicable to the holiday imposed by third parties not directly involved in the performance of the holiday, including tourist taxes, landing taxes or embarkation or disembarkation fees at ports and airports; and
  3. the exchange rates relevant to the Fora Package.
23.2.
If this means that you have to pay an increase of more than 8% of the total price of your confirmed Fora Package, then you will have the option of accepting a change to another Fora Package if we are able to offer one (if this is of a lower quality you will be refunded the difference in price), or cancelling and receiving a full refund of all monies paid to us.
23.3.
We will give you a reasonable period of time to make your decision, which will usually be 7 days from notification of the price increase. If we do not hear from you within this timeframe, we shall send a reminder to you, following which we shall be entitled to cancel the Fora Package booking and provide you with a refund.
23.4.
Should the price of your Fora Package go down due to the changes mentioned above, then any refund due will be paid to you less any administrative fee of £50. However, please note that travel services are not always purchased in local currency and some apparent changes have no impact on the price of your Fora Package due to contractual and other protection in place.
23.5.
There will be no change made to the price of your confirmed Fora Package within 20 days of your departure nor will refunds be paid during this period.

24. Your right to transfer your package holiday

24.1.
You have the right to transfer your place on your Fora Package to another person, subject to compliance with the following conditions:
  1. that person is introduced by you and satisfies all the conditions applicable to the Fora Package;
  2. the request to transfer is made in writing to your Travel Advisor at least 7 days before the start of the Fora Package, and includes the name and other applicable details of the person who will replace you. Your Travel Advisor will forward the request to us;
  3. you pay any outstanding balance payment as well as any additional fees, charges or other costs (such as those imposed by any Supplier/Principal or the Travel Advisor) arising from the transfer; and
  4. the transferee agrees to these Booking Conditions.
24.2.
You and the transferee remain jointly and severally liable for payment of all sums. If you are unable to find a replacement, you can choose to cancel your booking in accordance with clause 26 below. Otherwise, no refunds will be given for customers not travelling or for unused services.

25. If you wish to make a change to your package holiday

25.1.
If after we have issued you with a booking confirmation, you wish to make an amendment to the booking, please contact your Travel Advisor. Any notice of amendment must be given by the Lead Name on the booking. Your Travel Advisor will check whether the amendment can be made.
25.2.
If the amendment is possible, your Travel Advisor will let you know about any changes to the price of the booking or anything else which would be necessary as a result of your request amendment, and ask you to confirm whether you wish to go ahead with the amendment. Where your requested amendment can be met, you must pay all costs and charges incurred or imposed by any of the Supplier/Principals together with any administration fees.
25.3.
If the amendment cannot be made or the consequences of making the amendment (such as an increased price) are unacceptable to you, you may want to cancel your booking (see clause 26).
25.4.
Please note that certain Supplier/Principals of travel services making up your Fora Package may not allow changes or transfers after the booking has been confirmed and any change could incur a cancellation charge of up to 100% of that part of the Fora Package and require you to re-book.

26. If you wish to cancel your package holiday

26.1.
You, or a member of your party, may cancel your confirmed Fora Package at any time. To do so, you must provide written notice of cancellation to your Travel Advisor, who will forward your notice to us. Your cancellation will take effect when we receive the written notice from your Travel Advisor. Any such notice of cancellation must be given by the Lead Name on the booking.
26.2.
As we may have incurred costs in relation to a cancelled booking (including, without limitation, charges which are imposed on us by the Supplier/Principals providing your Fora Package), you will be charged a cancellation fee per person which reflects the losses and costs which we incur in cancelling the booking (please ask if you would like to understand how these charges are calculated). The following cancellation charges apply to Fora Packages. The amount payable is calculated based on the date we receive your cancellation notice from your Travel Advisor.

26.3.
Should one or more members of a party cancel, it may increase the per person holiday price of those still travelling and you will be liable to pay this increase.
26.4.
Certain arrangements (such as flights) may not be amended after they have been confirmed and any alteration or cancellation could incur a cancellation charge of up to 100% of that part of the Fora Package.
26.5.
If the reason for your cancellation is covered under the terms of your insurance policy, you may be able to reclaim these charges.
26.6.
We will deduct the cancellation charge(s) from any monies you have already paid to us.
26.7.
You have the right to cancel your confirmed Fora Package before departure without paying any cancellation charges in the event of Unavoidable and Extraordinary Circumstances (as defined in clause 30) occurring at the place of destination or its immediate vicinity which significantly affect the performance of the holiday or significantly affect the carriage of passengers to the destination. If you cancel in these circumstances, we shall provide you with a full refund of any monies you have paid for your Fora Package, but you will not be entitled to compensation.

27. If we make a change to your package holiday

Minor changes

27.1.
As the arrangements which make up your Fora Package are planned many months in advance, from time to time we may need to make a change to your confirmed booking, and we reserve the right to do so at any time. Most changes will be minor and, where there is time before departure, we will inform your Travel Advisor as soon as reasonably possible and your Travel Advisor will notify you. We will not be liable for minor changes. Examples of minor changes include: a change to the timing of transfers or activities that does not significantly affect the overall itinerary; alteration of your outward/return flights by less than 12 hours; changes to aircraft type; change of accommodation to another of the same or higher standard; a change to the order in which activities or excursions are carried out; or a change of carrier.

Significant changes

27.2.
Occasionally we may be required to make a significant change that we are constrained to make to the main characteristics of your Fora Package, or we may not be able to fulfil a special requirement which we had previously accepted. Examples of “significant changes” before departure include:
  1. A change of accommodation area for the whole or a significant part of your time away.
  2. A change of accommodation to that of a lower standard or classification for the whole or a significant part of your time away.
  3. A change of outward departure time or overall length of your arrangements by more than 12 hours.
  4. A significant change to your itinerary, missing out one or more destination entirely.
  5. A change of UK departure airport except between:
    1. The London airports: Gatwick, Heathrow, Luton, Stansted, London City and Southend
    2. The South Coast airports: Southampton, Bournemouth and Exeter
    3. The South Western airports: Cardiff and Bristol
    4. The Midlands airports: Birmingham, East Midlands and Doncaster Sheffield
    5. The Northern airports: Liverpool, Manchester and Leeds Bradford
    6. The North Eastern airports: Newcastle and Teesside
    7. The Scottish airports: Edinburgh, Glasgow, Prestwick and Aberdeen.
27.3.
In the unlikely event that we have to make a significant change to your confirmed Fora Package, we will inform your Travel Advisor as soon as reasonably possible and they will notify you. You will then have the option to:
  1. accept the proposed change. If this results in a holiday of lower quality or cost, we will refund you the difference in price;
  2. reject the proposed change and cancel your confirmed Fora Package, in which case we will provide you with a full refund of all monies paid; or
  3. reject the proposed change, cancel your Fora Package and take a substitute one if we are able to offer one. We will notify your Travel Advisor of any impact on the price of your booking. If the alternative is of a lower quality or cost, we will refund you the difference in price.
27.4.
We will give you a reasonable period of time to make your decision (usually 7 days from notification via your Travel Advisor) to decide how you wish to proceed. If we do not hear from you within this timeframe, we shall send a reminder to you. If there is still no response, we shall be entitled to cancel the booking and refund all monies paid.
27.5.
If you decide to reject the proposed change and cancel your booking with a full refund of all monies paid, you may also be entitled to compensation in accordance with clause 29 below.
27.6.
If, after departure, we become unable to provide a significant proportion of the Fora Package that you have booked, we will, if possible, make alternative arrangements for you at no extra charge. Where those alternative arrangements are of a lower standard, we will provide you with an appropriate price reduction.

28. If we have to cancel your package holiday

28.1.
On rare occasions, we may have to cancel your confirmed Fora Package and we reserve the right to do so. If this happens, we will notify your Travel Advisor as soon as reasonably possible, and they will notify you. Where we cancel your Fora Package, we will offer you a substitute Fora Package if available and inform your Travel Advisor of any impact on the price of your booking. If the substitute Fora Package is of a lower quality or cost, we will refund you the difference in price. If we cannot offer you a substitute Package, or if you would prefer to cancel, we will provide you with a full refund of any payments made for the Fora Package.
28.2.
You may be entitled to compensation as a result of our cancellation of your Fora Package in accordance with clause 29 below.

29. Compensation

29.1.
In the event we make a significant change or cancel your Fora Package and you choose to cancel your booking, in addition to a full refund of all monies paid by you, we may pay you compensation as detailed in the table below. The compensation that we offer does not exclude you from claiming more if you are entitled to do so.
29.2.
We will not pay you compensation where we have to cancel your Fora Package as a result of:
  1. your failure to make full payment on time;
  2. where the change or cancellation arises out of changes to the confirmed booking requested by you; or
  3. where we are forced to cancel or change your Fora Package due to Unavoidable and Extraordinary Circumstances (as defined in clause 30).

30. Unavoidable and extraordinary circumstances

30.1.
In these Booking Conditions, where we refer to Unavoidable and Extraordinary Circumstances, it means a situation beyond the control of the party who invokes such a situation and the consequences of which could not have been avoided even if all reasonable measures had been taken.
30.2.
This may cover for example an outbreak of war or other serious security problems such as terrorism, significant risks to human health such as the outbreak of a serious disease at the travel destination, or natural disasters such as floods, earthquakes or weather conditions which make it impossible to travel safely to the destination as agreed in the package travel contract.

31. Our responsibility for the performance of your package holiday

31.1.
We accept responsibility for your Fora Package as an “Organiser” under the PTRs as set out in this clause 31. This means we are responsible for the proper performance of the travel services included in your Fora Package, as confirmed in your booking documentation. If we or any of the Supplier/Principals providing travel services as part of your Fora Package negligently perform or arrange those services, and we do not remedy or resolve your complaint within a reasonable period of time and this affects the enjoyment of your Fora Package, you may be entitled to an appropriate price reduction or compensation or both. You must inform your Travel Advisor without undue delay of any failure to perform or improper performance of the travel services included in your Fora Package. The level of any price reduction or compensation will take into account all relevant factors, including but not limited to: whether you followed the complaints procedure in these Booking Conditions and the extent to which any negligence by us or our Supplier/Principals affected the overall enjoyment of your Fora Package. Please note that it is your responsibility to show that we or the Supplier/Principals were negligent if you wish to make a claim.
31.2.
We will not be responsible or pay you compensation for any injury, illness, death, loss, damage, expense, cost or other claim of any description if it results from:
  1. The acts and/or omissions of the person affected; or
  2. The acts and/or omissions of a third party unconnected with the provision of the services contracted for and which were unforeseeable or unavoidable; or
  3. Unavoidable and Extraordinary Circumstances (as defined in clause 30).
31.3.
We cannot accept responsibility for:
  1. any services that do not form part of your Fora Package. This includes, for example, any services or facilities that a Supplier/Principal agrees to provide to you where the services or facilities are not advertised by us as forming part of your Fora Package, and any excursions or activities you purchase while on holiday;
  2. any damage, loss, expense or other sum(s) of any description which on the basis of the information given to us by you concerning your booking prior to our accepting it, we could not reasonably have foreseen you would suffer or incur if we breached our contract with you, or which did not result from any breach of contract or other fault by ourselves or our employees or, where we are responsible for them, our suppliers; or
  3. any expenses or losses that relate to or arise from any business (including without limitation, self-employed loss of earnings), or any indirect or consequential loss of any kind.
31.4.
We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or sub-contractors; or for fraud or fraudulent misrepresentation.
31.5.
If we are found liable, our liability will be limited as follows:
  1. Loss of and/or damage to any luggage or personal possessions and money: the maximum amount we will have to pay you in respect of these claims is an amount equivalent to the excess on your insurance policy which applies to this type of loss per person in total because you are required to have adequate insurance in place to cover any losses of this kind.
  2. Claims not falling under (a) above and which don’t involve injury, illness or death: the maximum amount we will have to pay you in respect of these claims is up to three times the price paid by or on behalf of the person(s) affected in total. This maximum amount will only be payable where everything has gone wrong and you or your party has not received any benefit at all from your booking.
  3. Claims in respect of international travel by air, sea and rail, or any stay in a hotel: The extent of our liability will in all cases be limited as if we were carriers under the appropriate Conventions, which include The Warsaw/Montreal Convention (international travel by air); The Athens Convention (with respect to sea travel); The Berne/Cotif Convention (with respect to rail travel) and The Paris Convention (with respect to hotel arrangements). You can ask for copies of these Conventions from our offices. Please contact us. In addition, you agree that the operating carrier or transport company's own ‘Conditions of Carriage’ will apply to you on that journey. When arranging transportation for you, we rely on the terms and conditions contained within these international conventions and those ‘Conditions of Carriage’. You acknowledge that all of the terms and conditions contained in those ‘Conditions of Carriage’ form part of your contract with us, as well as with the transport company and that those ‘Conditions of Carriage’ shall be deemed to be included by reference into this contract.
31.5.1.
In any circumstances in which a carrier is liable to you by virtue of the Denied Boarding Regulation 2004, any liability we may have to you under our contract with you, arising out of the same facts, is limited to the remedies provided under the Regulation as if (for this purpose only) we were a carrier.
31.5.2.
When making any payment, we are entitled to deduct any money which you have received or are entitled to receive from the transport provider or hotelier for the complaint or claim in question.
31.6.
It is a condition of our acceptance of liability under this clause that you notify any claim to your Travel Advisor, who will forward it to us and, where appropriate, to the relevant Supplier/Principal(s) strictly in accordance with the complaints procedure set out in these Booking Conditions.
31.7.
Where any payment is made, the person(s) receiving it (and their parent or guardian if under 18 years) must also assign to us or our insurers any rights they may have to pursue any third party and must provide ourselves and our insurers with all assistance we may reasonably require.
31.8.
Where it is impossible for you to return to your departure point as per the agreed return date of your Fora Package due to Unavoidable and Extraordinary Circumstances (as defined in clause 30), we shall provide you with any necessary accommodation (where possible, of a comparable standard) for a period of up to three nights per person. Please note that the 3-night cap does not apply to persons with reduced mobility, pregnant women or unaccompanied minors, nor to persons needing specific medical assistance, provided we have been notified of these particular needs at least 48 hours before the start of your Fora Package.
31.9.
Excursions or other tours that you may choose to book or pay for whilst you are on holiday are not part of your contracted arrangements with us. For any excursion or other tour that you book, your contract will be with the operator of the excursion or tour and not with us. We are not responsible for the provision of the excursion or tour or for anything that happens during the course of its provision by the operator.

32. Prompt assistance whilst overseas

32.1.
We will provide you with appropriate assistance without undue delay if you are in difficulty during your Fora Package. Your first point of contact should be your Travel Advisor, who will liaise with us where necessary. We will provide support by giving you appropriate information on health services, local authorities and consular assistance; and by helping you make distance communications and helping you find alternative travel services. Typically, we do not charge for this assistance, although we do reserve the right to charge a reasonable fee for such assistance if the difficulty has been caused intentionally by you or through your negligence.

33. Financial protection for package holidays

33.1.
The PTRs require us to provide security for the monies that you pay for your Fora Package and for your repatriation in the event of our insolvency.

Flight-inclusive Fora Packages

33.2.
For flight-inclusive package holidays organised by Fora and ATOL protected flight only sales, we provide this protection by way of our ATOL number 12730 issued by the Civil Aviation Authority, Gatwick Airport South, West Sussex, RH6 0YR, UK, telephone 0333 103 6350, email: claims@caa.co.uk.
33.3.
When you buy a flight inclusive Fora Package or an ATOL protected flight only booking from us you will receive an ATOL Certificate. This lists what is financially protected, where you can get information on what this means for you and who to contact if things go wrong.
33.4.
We, or the suppliers identified on your ATOL Certificate, will provide you with the services listed on the ATOL Certificate (or a suitable alternative). In some cases, where neither we nor the supplier are able to do so for reasons of insolvency, an alternative ATOL holder may provide you with the services you have bought (at no extra cost to you). You agree to accept that in those circumstances the alternative ATOL holder will perform those obligations and you agree to pay any money outstanding to be paid by you under your contract to that alternative ATOL holder. However, you also agree that in some cases it will not be possible to appoint an alternative ATOL holder, in which case you will be entitled to make a claim under the ATOL Scheme (or your credit card issuer where applicable). If we, or the suppliers identified on your ATOL certificate, are unable to provide the services listed (or a suitable alternative, through an alternative ATOL holder or otherwise) for reasons of insolvency, the Trustees of the Air Travel Trust may make a payment to (or confer a benefit on) you under the ATOL scheme. You agree that in return for such a payment or benefit you assign absolutely to those Trustees any claims which you have or may have arising out of or relating to the non-provision of the services, including any claim against us, the travel agent (or your credit card issuer where applicable). You also agree that any such claims may be re-assigned to another body, if that other body has paid sums you have claimed under the ATOL scheme.
33.5.
The price of our flight inclusive arrangements includes the amount of £2.50 per person as part of the ATOL Protection Contribution (APC) we pay to the CAA. This charge is included in our advertised prices. Not all holiday or travel services offered and sold by us will be protected by the ATOL Scheme. ATOL protection extends primarily to customers who book and pay in the United Kingdom. For further information, visit the ATOL website at https://www.caa.co.uk/home/.

Non-flight Fora Packages and Linked Travel Arrangements

33.6.
We provide financial protection for Fora Packages which don’t include flights and Linked Travel Arrangements by way of a bond held with ABTA Limited. Our ABTA membership number is Y6886. ABTA will financially protect your Fora Package or LTA in the unlikely event of our insolvency by arranging for you to receive a refund and, if your Fora Package or LTA includes transport to and from the UK, for you to be repatriated. In this case, if already abroad, you will be returned to the point where your Fora Package or LTA commenced.

34. Flight arrangements

34.1.
No liability for delays to flights or other transport. Air, rail, road and other departure times are supplied by the carriers. They are subject to, inter alia, air traffic control restrictions, weather conditions, the need for maintenance and the ability of passengers to check in on time. We do not have any liability to you for any delays that may arise (including any at your international departure airport). We will provide you with information and advice to the extent we are in a position to do so. Where applicable, the airline is responsible for providing any assistance as is legally required by EC 261/2004 (denied boarding and flight disruption) (see clause 34.4 below). Otherwise, any arrangements in the event of a delay will be at the sole discretion of the airline or other carrier involved.
34.2.
Community list. In accordance with EU Directive (EC) No 2111/2005, we are required to bring to your attention the existence of a ‘Community list’ that contains details of air carriers that are subject to an operating ban within the EU Community. The Community list is available for inspection at http://ec.europa.eu/transport/modes/air/safety/air-ban_en.
34.3.
Change of carrier. We are also required to advise you of the carrier(s) or, if the carrier(s) is not known, the likely carrier(s)) that will operate your flight(s) at the time of booking. Where we are only able to inform you of the likely carrier(s) at the time of booking, we shall inform you of the identity of the actual carrier(s) as soon as we become aware of this. Any change to the operating carrier(s) after your booking has been confirmed will be notified to you as soon as possible. We are not always in a position at the time of booking to confirm flight timings. The flight timings shown on our website and detailed on your confirmation invoice are for guidance only and are subject to alteration and confirmation. The latest timings will be shown on your tickets that will be dispatched to you approximately two weeks before departure. You must accordingly check your tickets very carefully immediately on receipt to ensure you have the correct flight times. It is possible that flight times may be changed even after tickets have been despatched – in which case either your Travel Advisor or the airline, will contact you as soon as possible if this occurs. Any change in the identity of the carrier, flight timings, and / or aircraft type (if given) will not entitle you to cancel or change to other arrangements without paying our normal cancellation charges except where specified in these terms. If the carrier with whom you have a confirmed reservation becomes subject to an operating ban as above and we / the carrier are unable to offer you a suitable alternative, the provisions of clause 27 will apply.
34.4.
If your flight is cancelled or delayed. If your flight is cancelled or delayed, your flight ticket is downgraded or boarding is denied by your airline, depending on the circumstances, the airline may be required to pay you compensation, refund the cost of your flight and/or provide you with accommodation and/or refreshments under EC Regulation No 261/2004 (denied boarding and flight disruption). Where applicable, you must pursue the airline for the compensation or other payment due to you. All sums you receive or are entitled to receive from the airline concerned by virtue of these Regulations represent the full amount of your entitlement to compensation or any other payment arising from such cancellation, delay, downgrading or denied boarding. This includes any disappointment, distress, inconvenience or effect on any other arrangements. The fact a delay may entitle you to cancel your flight does not automatically entitle you to cancel any other arrangements even where those arrangements have been made in conjunction with your flight. We have no liability to make any payment to you in relation to EC261 or in respect of any flight cancellation or delay, downgrading of any flight ticket or denial of any boarding as the full amount of your entitlement to any compensation or other payment (as dealt with above) is covered by the airline’s obligations under EC261. If, for any reason, we make any payment to you or a third party which the airline is responsible for in accordance with EC261 or otherwise, you must, when requested, make a complete assignment to us of the rights you have against the airline in relation to the claim that gives rise to that payment. If your airline does not comply with these rules you may use the CAA Passenger Advice and Complaints Service. See https://www.caa.co.uk/Passengers/Resolving-travel-problems/ for further details.
34.5.
Advance Passenger Information. A number of governments are introducing new requirements for air carriers to provide personal information about all travellers on their aircraft to the authorities before the aircraft leaves the UK. The data will be collected either at the airport when you check in or in some circumstances when, or after you make your booking. Accordingly, you are advised to allow extra time to check in for your flight. Where we collect this data, we will treat it in accordance with our privacy policy.

Fora Packages: standard information form on traveller’s key legal rights

Part 1 — General

The combination of travel services offered to you is a package within the meaning of the Package Travel and Linked Travel Arrangements Regulations.

Therefore, you will benefit from all UK rights applying to packages. Where you have booked a Fora Package (as defined in the Booking Conditions), Fora Travel, Inc, will be fully responsible for the proper performance of the package as a whole.

Additionally, as required by law, Fora Travel, Inc. has protection in place to refund your payments and, where transport is included in the package, to ensure your repatriation in the event that it becomes insolvent.

Part 2 — Key rights under the Package Travel and Linked Travel Arrangements Regulations 2018

  • Travellers will receive all essential information about the package before concluding the package travel contract.
  • There is always at least one trader who is liable for the proper performance of all the travel services included in the contract.
  • Travellers are given an emergency number or details of a contact point where they can get in touch with the organiser or travel agent.
  • Travellers may transfer the package to another person, on reasonable notice and possibly subject to additional costs.
  • The price of the package may only be increased if specific costs rise (for instance fuel prices), and if expressly provided for in the contract, and in any event not later than 20 days before the start of the package. If the price increase exceeds 8% of the price of the package, the traveller may terminate the contract. If the organiser reserves the right to a price increase, the traveller has a right to a price reduction if there is a decrease in the relevant costs.
  • Travellers may terminate the contract without paying any termination fee and get a full refund of any payments if any of the essential elements of the package, other than the price, are changed significantly. If before the start of the package the trader responsible for the package cancels the package, travellers are entitled to a refund and compensation where appropriate.
  • Travellers may terminate the contract without paying any termination fee before the start of the package in the event of exceptional circumstances, for instance if there are serious security problems at the destination which are likely to affect the package.
  • Additionally, travellers may at any time before the start of the package terminate the contract in return for an appropriate and justifiable termination fee.
  • If, after the start of the package, significant elements of the package cannot be provided as agreed, suitable alternative arrangements will have to be offered to the traveller at no extra cost. Travellers may terminate the contract without paying any termination fee, where services are not performed in accordance with the contract and this substantially affects the performance of the package and the organiser fails to remedy the problem.
  • Travellers are also entitled to a price reduction or compensation for damages or both where the travel services are not performed or are improperly performed.
  • The organiser has to provide assistance if the traveller is in difficulty.
  • If the organiser becomes insolvent, payments will be refunded. If the organiser becomes insolvent after the start of the package and if transport is included in the package, repatriation of the travellers is secured.
